I'm not sure. Perhaps if you explain to your congressman that on the USCIS website it states that they are working on September 30 cases, meaning that your application should have already been processed, it might help.

You can still get an ID and DL in Florida if you're approved for the EAD. The bill that was vetoed by the Governor was to allow people to obtain an ID and DL with just DACA alone, so nothing changed. The state law still says that anyone with an EAD can apply for an ID and DL. -

I think the issue here is going to be that you left for almost a year after being here initially for 4 years. That departure might make those 4 years irrelevant because it wasn't very brief, so they might not take it into consideration. If they don't, you'll have to prove that you came here before 16. So if you came illegally, you're going to need evidence that you came before turning 16. If you do have that evidence, the next issue would be whether you established residency after you arrived. How long did you stay in the U.S. before leaving again?- 25 replies

I'm not really sure if you can. You replied to the RFE with insufficient evidence and were denied because of that, not because of an error by USCIS. Perhaps because it was an error from your attorney it might be different. Hopefully you can sort it out.

You should call the NSCS and tell them that, perhaps there might be a different issue than them just overlooking the evidence.

That's weird. I would send those same things again. Also, on the RFE it should tell you what items you can send in to prove your identity. Before you send anything, you might want to call the NSCS and tell them about the RFE and what evidence you had initially sent in to see what they have to say about it.

You should be fine with the EAD. You can use a U.S. Federal or State ID.

You mean on the EAD, there's no such thing as a DACA card Anyways, that's how it's supposed to be. Paternal last name comes before the Maternal last name. As far as applying for stuff, I think you're going to have to apply with your complete name as shown on your EAD and SSN.

That's usually how it works, but who knows. Your case might show up later, or you might be one of those unlucky ones who's status doesn't show up until there's an update to their case.

If you don't have anything else, then you're going to have to get people to write you letters stating that they have saw you during that time. Where were you living during that time. If you were renting, perhaps the landlord could write you a letter stating that you or your family were renting his home and that you were living there.

Some people say that they never received a text or e-mail, but that's because they thought that by sending in form G-1145 they would get notified whenever there was an update to their case. Form G-1145 was only to be notified when the lockbox had received your application. If you want to get further text and e-mail updates, you have to create an account on the USCIS website and add your Receipt Numbers to your Case Portfolio, then turn on the E-mail and Mobile Alerts. Did you make any online purchases under your name? If you did, check your e-mail for receipts. I don't know what else to tell you. You're going to have to think what you did for that year and try to find a paper trail if there is one.

Just like with the entire process, it varies. There's no set time. Some people have been approved within a week after sending back an RFE response , while others have waited past 60 days. -
That's just my opinion. You should consult with your lawyer though.
